FAMILY AND MEDICAL LEAVE (FMLA)  

WHO IS ELIGIBLE:  

Regular employees working half time ore more and  have worked for FCPS the past 12 months

TYPE OF LEAVE COVERED:  

§         Birth, adoption, or foster care placement of a son or daughter

§         Care for employee’s spouse, son, daughter or parent with a serious health condition

§         Serious health condition of the employee

DESIGNATION OF FMLA LEAVE:  

§         Employee may take up to 12 weeks of leave during a 12-month period for FMLA-qualifying absences

§         When both spouses are employed with FCPS and are eligible for leave, both employees may take a total of 12 weeks for certain family medical reasons

§         The 12-month period for FCPS begins each July 1

§         FMLA leave may consist of paid or unpaid leave

§         Serious health condition is defined as a condition requiring medical care and if left untreated, would result in a period of incapacity of more than three days

BENEFITS DURING FMLA LEAVE:  

§         Health/dental insurance coverage will continue under same conditions that applied before FMLA leave started

§         Employee may return to same position or to a position with equivalent pay, benefits and other terms of employment
